The Collapse of the 28-Clause Peace Initiative for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the crisis caused by the introduction of a new 28-article proposal for achieving ceasefire appeared – temporarily – to have been contained. A senior US official spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its retaliation: a renewed assault of rocket attacks on Kyiv.

The Cycle of Diplomacy and Destruction

The succession of contrasting events captured the harsh reality of the outgoing year. By day, negotiation efforts are fought: positive announcements are released from various governments. Significant resources is devoted on containing certain initiatives. By night, Moscow forcefully demonstrates the world that, for them, conflict continues to be the primary tool for achieving "settlement".

Nighttime Reality

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was laid bare. Ukraine is capable of detecting rocket firings from across the border, a capability enabled by current data. From vantage locations, defense planes that had been scrambled to intercept incoming cruise missiles streaked across the sky – sophisticated military planes supplied to Ukraine by European allies.

Shortly after, Kyiv's anti-aircraft weapons activated: defensive missiles deployed against a hostile projectile. This was a modern interception technology at work, most likely provided by allied countries. Every firing jolts you unexpectedly, rattling buildings. The moment of terror quickly gives way to resigned acknowledgment: perhaps the incoming missile won't hit its mark this time, sparing the city from devastation and another blackout.

Persistent Threats

Not long after, a large-caliber weapon engaged a drone somewhere nearby, part of a rapid response unit – most likely imported technology. Unfortunately, the bullets missed the hostile drone – it continued its flight toward its objective.

Periodically, this continued until dawn. Kyiv faced the early updates: seven people killed, damage and infrastructure problems in many homes as a result of the nocturnal offensive. As always, everyone still went about their day – living the war. But those entire period encapsulated Ukraine's essential dependence on Western support – a reliance that neighboring countries are demonstrably unable to fill in the immediate future.

Unsuccessful Negotiations

The comprehensive proposal from Washington provoked deep reactions, controversy and serious worry – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after previous diplomatic encounters and international summits.

Every new proposal from American administration follows the identical sequence: a political offensive against Ukraine, which Kyiv, with other European capitals, manages to fend off. They contain the crisis but never actually win the battle. This cycle will, certainly, continue.

Political Considerations

It is convenient to criticize specific actors of repeatedly advocating Moscow's conditions. But that does not seem to be the complete picture. Washington functions according to a assumption well known to experienced diplomats: you cannot secure via talks what you have lost on the battlefield. The US administration presumes that it is impossible to compel Moscow to relinquish the land that it already controls in Ukraine's southern or eastern regions.

The challenge is that while accepting these circumstances, Washington does minimal to discourage Russia, through words or deeds, from assuming that the status quo will not evolve additionally in its favour in the coming year.

Conflicting Perspectives

Therefore, Russian leadership is confident that the clock favors them – that Ukraine and its partners are coming close to fatigue. Their motivation to accept conditions that does not give them the largest achievable advantage is close to zero. There may be multiple initiatives to end hostilities, but they will continue as long as Russia's government remains highly assured in the result.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, gradually sacrificing lives and land but averting a entire defensive failure until circumstances change in its favour.

Present Conditions

Factually, there are no genuine requirements for a truce. Now, personal considerations are coming into play: leadership ambitions to negotiate peace and obtain worldwide acknowledgment, and Ukrainian leadership's dual difficulties – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the national cause against any proposal Kyiv finds unsuitable, so that their focus does not switch to homefront challenges. And although their task will now be much harder after current events, it remains highly unlikely that this will change their overall approach.

These conflicting dynamics are driving the talks.

Assessment and Future

It took a just a single week to kill the proposed articles of the most recent proposal. Forceful and unpredictable management of the matter by Washington, resistance by Ukraine and the other European countries, along with soothing efforts of negotiators, and finally, recent disclosures, all served their function.

While new plans based on previous concepts are forthcoming, Kyiv, London and other Western governments should arrive at a critical understanding: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are rooted in Kremlin requirements and reflect particular unwillingness to alter the situation, if they stand together and strengthen their defence capabilities at a much faster pace. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the coming months, mainly require sustained allied backing.
